Hang on to your Guns!!!
Senator Tom Coburn is leading the fight against
the National Park Service
gun ban. While the Interior Department
recently (after seven years of foot-dragging)proposed new rules
to partially reverse the gun ban, they have not yet taken
effect. If and when they do go into effect, most gun owners
would still not
be allowed to possess firearms on these lands
because, among other problems
with the rule, open carry would remain
prohibited. Senator Coburn is the sponsor of a bill, S.
2619, to make the gun ban repeal
complete and permanent.

Do you want the Corps and EPA in your backyard? H. R. 2421, also known as the National Wetlands Corps of Engineers Land Grab Bill. The Senate version is S 1870 and is worded exactly like HR 2421. H.R. 2421 is sponsored by House Transportation and Infrastructure Committee Chairman James Oberstar (D-MN). The sister Bill S 1870 is sponsored by Senator Russ Feingold (D-WI). By wording both bills the same, they are looking to ram through this bill fast before we get a chance to get organized. H.R. 2016 sponsors are using the same tactic!!!
Background Congress is considering expanding the jurisdiction of the "Clean Water Act of 1972" to include all waters of the United States. The Goal Of (HR 2421), the Clean Water Restoration Act, Is to provide jurisdiction to the Corps of Engineers and EPA over All Watersheds. The change will not limit jurisdiction to “navigable waters” as is currently the law.
Determined under two Supreme Court Decisions, the Rapanos and SWANCC Supreme Court Decisions of 2006 and 2001 respectively limited the power of these agencies. The inappropriately named Clean Water Restoration Act. HR 2421 has little to do with clean water and is exclusively about land use control. It became clear what Rep. Oberstar is really up to at the House Transportation Committee Hearing on Oberstar’s Clean Water Act Wetlands Land Grab Bill (HR 2421) on April 16th. Transportation Committee Chairman Oberstar is trying to pull the wool over our eyes, and tell us everything will be just fine!!! Upon further examination, this is far from the truth!!!
Mr. Oberstar is planning to leave the word “navigable” in HR 2421, but distorts the true meaning of this with new language that essentially guts the meaning currently in statute. Congress is also considering expanding Clean Water Act jurisdiction to include all “activities affecting these waters.” This provision is essentially a limitless national land use control provision.
Be aware of the legal concept called “laches” or “sleeping on your rights.”
You may lose future legal rights later if you fail to comment or testify on HR 2421. Montanans For Multiple Use v. Barbouletos et.al., recently showed us that there is room for interpretation of the administrative rules that even if futile, we are required to participate in and exhaust our administrative procedures afforded to us. The Courts also showed the power of the personal interpretation of the powers of the judicial process with the case of; Seven Up Pete Venture v. Brian Schweitzer, Governor of Montana (No. 0635384 Ninth Circuit Court) In this case, the protections of private property rights guaranteed under the constitution can and have been overturned by the Constitution itself. One can see the trend in our judicial system further in the Heller v. DC case and the second amendment rights! The list goes on, and so will the taking of rights if we do not fight!!!
